1. GENERAL PROVISIONS
1.1. "N.CAPITAL" (https://www.ncapital.rs) (hereinafter: "Website") is the internet site owned by the following entity:

The Company (hereinafter: "N Capital") is registered in the Business Entities Register operated by the Business Registers Agency of the Republic of Serbia.
1.2. N Capital provides Services to Users, allowing them to access the Content published on the Website, in accordance with these Terms of Use.
1.3. These Terms of Use govern the relation between N capital and its Users, their mutual rights, obligations and liability. By registering, User agrees unconditionally, irrevocably and with no limits whatsoever to comply with all the terms and conditions hereof. User understands and agrees that his registration on the Website shall be deemed as an acceptance of these Terms of Use, from then on.
1.4. User agrees unconditionally and irrevocably to use the Services in compliance with these Terms of Use. As used in these Terms of Use, certain terms mean the following:
"N Capital" is a legal entity organized in the legal form of Entrepreneur, with business data as listed in section 1.1. of these Terms of Use (General Provisions), acting as an owner and editor of the Content of the Website. N Capital is not a VAT payer.
"User" (plural: "Users") is a natural person or persons, or legal entity, either foreign or domestic, who uses the Services by accessing the Website at the URL address https://www.ncapital.rs, regardless of the device used for access, period of use, physical or virtual location from which they access the Website.
"Website" is a web page named "N Capital", located at the address https://www.ncapital.rs.
"Services" include providing Content to the Users with charges, as well as booking a seats in nightclubs and other hospitality facilities in Belgrade, with prior registration of the User.
"Content" includes texts, scripts, graphics, images, sounds, videos, audio-visual content, interactive content and other material published on the Website.
"User Data" is User(s) personal data that is collected during the use of the Services and during access to the Content, and other data provided by the User to N Capital for the purpose of registration.
2. USER REGISTRATION
2.1. Users are granted access to the Content upon signing-up. Only registered users can access the Website.
2.2. User registration starts by recieving an invitation email from N Capital, which contains link to the registration website.
2.3. Registration is completed by creating a User account on the Website, providing the following User Data: Name and last name; phone number; email address; password chosen by the User; Registration process is finalized by payment of membership fee. Following the payment, N Capital activates Users account and grants him the access to the Content and use of Services.
2.4. Following creation of user account and payment of a membership fee, the User is allowed access to the Content on the Website.
2.5. Membership lasts one month, starting from the date of registration.
2.6. User may renew subscription when subscription expires.
2.7. The password created by the User is for personal use only, and neither user account nor password may not be transferred to third parties.
3. DESCRIPTION AND USE OF SERVICES
3.1. Users become registered members by paying a fee when first creating a user account and they are granted the unlimited access to the Website thereof, for the period of membership duration.
3.2. Users may book seats in night clubs and other facilities as listed and described on the Website.
3.3. User makes a reservation of seats by clicking on the link in the description of the facility, and selecting the wanted date, time and number of seats. The reservation is finalized when a confirmation from N Capital is received that the reservation is successful.
3.4. Reservation must be made no later than two days before the selected date.
3.5. Users may cancel the reservation no later than 3 hours prior to the booked time, by sending cancelation note to N Capital using the contact form on Website.
4. PRICELIST AND PAYMENT FOR THE SERVICES
4.1. Membership fee is charged on a monthly basis, as determined by N Capital.
4.2. The amount of the membership fee is displayed on the Website when user account is created. By paying the fee, User gives consent to the displayed amount.
4.3. N Capital may change the method of payment and the amount of the fee. These changes shall not apply to already paid membership fees. N Capital shall notify Users about the changes of the fee and all changes shall be applied only after noticing the Users.
4.4. The monthly fee shall be charged in the local currency of the Republic of Serbia – RSD currency. The average exchange rate of the National Bank of Serbia is used for informative display of prices in other currencies. The amount for which the User's payment card will be charged for will be expressed in the User's local currency through a conversion to the User’s local currency at the rate used by the payment card organizations. There is a possibility of a slight difference from the original price stated on the Webpage as a result of this conversion.
4.5. The fee is payed using payment cards through service Chipcard, in accordance with the terms and conditions of Chipcard.
4.6. When typing in the payment card data, confidential information are transmitted by means of public network in the protected (cryptic) form using the SSL protocol and PKI system, currently the most- up-to-date technology. The security of data when making purchase is guaranteed by the payment card processor, Chip Card ad Belgrade,, thus the complete process of collection is performed on the Chip Card’s site. The data on the payment card are at no moment available to our system.
5. USER’S COMPLAINTS
5.1. User's complaints related to payment services must be submitted to N Capital via email or through the User’s support link displayed on the Website.
5.2. Users agree to send a written complaint regarding payment services to N Capital within six months from the moment User becomes aware of any irregularity.
5.3. N Capital agrees to resolve the complaint in the shortest time possible and no later than 7 days from receipt of complaint, as well as to inform the User of the resolution within the same period.
5.4. In the event of a user’s complaints and a refund of funds previously paid by one of the payment cards, in whole or in part, and regardless of the reason for the return, N Capital is obligated to repay the funds solely through VISA, EC / MC and Maestro payment methods.
6. LIMITATION OF SERVICES
6.1. Users may use the Services only in personal, non-commercial purposes, in accordance with these Terms of Use and Laws of the Republic of Serbia.
6.2. Users agree not to use the Services in any manner or in the purposes that violate any applicable laws or regulations of the Republic of Serbia.
6.3. The User shall not, without the approval of N Capital, download, copy, duplicate, broadcast, display, sell or in other way make available the Content of the Website to any third party. The User shall not distribute the Content without the approval of N Capital to the known or unknown persons, for any commercial or non-commercial purposes, with or without fee.
6.4. N Capital reserves the right to terminate or modify the appearance of the Website, Content and Terms of Use applicable to Users use of the Services, as well as to modify any services and sub-pages that are an integral part of the Webpage, without prior notice to the Users.
7. LIMITATION OF LIABILITY
7.1. Users agree and understand that N Capital provides a services of reservation of seats in hospitality facilities through the Website, but does not warrant in any way and is in no way liable for the services provided by third parties - night clubs and other hospitality facilities.
7.2. Users agree and understand that N Capital shall in no event be liable to the Users or third parties for damages, including without limitation material or immaterial, incurred or future, direct or indirect, financial or non-financial arising out of User's violation of these Terms of Use or Regulations of the Republic of Serbia, either suffered by N Capital or any third party.
7.3. Users agree and understand that N Capital provides the Services on an “as is” basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. N Capital will put it’s best efforts to provide the Services in accordance with the User’s request but in no way guarantees for the fulfillment of the User's request.
7.4. Users agree and understand that upon registration, no refund of the paid membership fees shall be possible.
7.5. Users accept and understand that N Capital shall not be responsible for any failure to provide Services due to circumstances beyond its reasonable control that could not have been anticipated or avoided.
8. USER SUPPORT
8.1. N Capital agrees to provide technical support to Users in order to overcome the difficulties in providing the Services (for example, loss of password, non-functioning of the Website, complaints regarding payment, etc.) within 24 hours from submitting request for technical support by the User.
8.2. Users may request technical support through a contact link that on the Website.
9. PRIVACY AND PERSONAL INFORMATION
9.1. N Capital is committed to protect the privacy of all Users. N Capital collects only the necessary personal data for functioning of N Capital in order to provide quality Services. N Capital will process the collected data only for the purpose of providing the Services.
9.2. All collected User data and information are confidential and may be accessed only by N Capital.
9.3. Users agree and understand that N Capital will store personal data provided by Users in the process of registration. N Capital shall not disclose or make these data available to any third parties.
9.4. Users agree and understand that N Capital shall forward the User’s personal data to the State authority, at the request of that authority, if such request is made, in accordance with the Law and with no prior information to the User.
9.5 N Capital collects only the necessary, personal data for functioning of N Capital in order to provide quality Services in accordance with good business practice. N Capital gives its users the option of choosing whether their personal data want or not to be deleted from the mailing lists used for marketing campaigns. All user data is strictly stored and accessible only to employees of N Capital. All employees of N Capital are responsible for respecting User’s privacy and personal information.
11. FINAL PROVISIONS
11.1. These Terms of Use enter into force from the day of their publication on the Website.
11.2. N Capital is authorized to change the Terms of Use at any time without any prior notice to the Users. The changes of the Terms of Use shall enter into force on the day of their publication on the Website.
11.3. These Terms of use are governed by Laws of Republic of Serbia law and are subject to all applicable laws and regulations. All issues and questions not regulated by these Terms of Use shall be subject to all applicable laws and regulations.
